Brandon Floch is a trial lawyer whose practice focuses on high-stakes, plaintiff-side commercial litigation. Known for pairing courtroom experience with strategic clarity, Brandon represents individuals, small businesses, and classes of investors in complex disputes where the stakes are high and the opposition well-resourced. He also takes on select defense matters that call for seasoned trial counsel.

Brandon has secured millions of dollars for his clients through early resolutions and contested litigation alike. His plaintiff-side work spans business torts, antitrust, personal injury, cryptocurrency, whistleblower actions, and securities fraud—and often involves going toe-to-toe with some of the largest institutions in the country. Brandon is frequently sought out by plaintiffs facing stalled cases; he excels at crafting strategic paths to resolution—whether through securing a favorable settlement or achieving a decisive win.

In addition to his plaintiff practice, Brandon handles select defense matters. For example, Brandon is currently defending Kevin O'Leary in multi-district class action litigation stemming from the collapse of the cryptocurrency exchange FTX. He often defends founders of various software and cryptocurrency companies in fraud cases.

He has significant trial experience in both civil and criminal matters. On the civil side, Brandon served as trial counsel in a nearly 40-day federal price-fixing case involving the egg industry—one of the most prominent antitrust trials in recent years. On the criminal side, he won a rare full acquittal for a Michigan tax lawyer accused of embezzling more than $6 million, defeating the U.S. Department of Justice at trial.

Before founding NMFA, Brandon was a partner at Marcus Neiman Rashbaum & Pineiro LLP and previously practiced at Kenny Nachwalter, where he worked on some of the most consequential antitrust litigations in the country. He began his legal career as a law clerk to the Honorable James J. Brady of the U.S. District Court for the Middle District of Louisiana.
